Welcome to Fab Everything ("Company," "we," "us," or "our"), a custom automotive fabrication company based in Oregon, USA. By accessing our website, placing an order, or using our products or services, you ("Customer," "you," or "your") agree to be bound by the following Terms and Conditions ("Terms"). Please read these Terms carefully before engaging with our Company.1. Nature of Products and Services
1.1. Custom Fabrication. All products and services provided by Fab Everything are custom-made to the specifications provided by the Customer or designed based on Customer requirements. Due to the bespoke nature of our work, each product is unique and crafted specifically for the Customer’s order.
1.2. Non-Regulated Products. All parts, components, and services provided by Fab Everything are custom in nature and are not certified, approved, or regulated by any governmental or regulatory body, including but not limited to the U.S. Department of Transportation (DOT), National Highway Traffic Safety Administration (NHTSA), or any international equivalent. Our products are intended for off-road, racing, or specialty use only, unless otherwise explicitly stated.
1.3. Use at Your Own Risk. By purchasing or using any product or service from Fab Everything, you acknowledge and agree that all products are used at your sole risk. You are responsible for ensuring that the use of our products complies with all applicable local, state, federal, and international laws, regulations, and standards. Fab Everything makes no representations or warranties regarding the legality, safety, or suitability of its products for any specific purpose.2. No Liability
2.1. Disclaimer of Liability. To the fullest extent permitted by law, Fab Everything, its owners, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to the purchase, use, installation, or performance of our products or services. This includes, but is not limited to, damages for personal injury, property damage, loss of use, or economic loss.
2.2. Assumption of Risk. By purchasing or using our products, you expressly assume all risks associated with their use, including but not limited to risks of product failure, improper installation, or incompatibility with your vehicle or intended application.
2.3. No Responsibility for Compliance. Fab Everything is not responsible for ensuring that its products meet any regulatory, safety, or compliance standards in your jurisdiction. You are solely responsible for verifying compliance with all applicable laws and regulations before using our products.3. Orders and Payment
3.1. Order Acceptance. All orders are subject to acceptance by Fab Everything. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or concerns about the feasibility of the custom specifications provided.
3.2. Pricing and Payment. All prices are quoted in U.S. dollars (USD) and are subject to change without notice. Payment is due in full at the time of order unless otherwise agreed in writing. Custom orders may require a non-refundable deposit.
3.3. Custom Order Specifications. You are responsible for providing accurate and complete specifications for custom orders. Fab Everything is not liable for errors, defects, or dissatisfaction resulting from inaccurate or incomplete specifications provided by you.4. Shipping and Delivery
4.1. Worldwide Shipping. Fab Everything ships products worldwide from our facility in Oregon, USA. Shipping costs, delivery times, and available carriers vary based on the destination and order specifications.
4.2. Customs and Duties. For international orders, you are solely responsible for any customs duties, taxes, or fees imposed by your country or any intermediary jurisdiction. Fab Everything is not responsible for delays or additional costs caused by customs processes.
4.3. Risk of Loss. Risk of loss or damage to products transfers to you upon delivery to the shipping carrier. Fab Everything is not liable for loss, damage, or delays occurring during transit.5. Returns and Refunds
5.1. No Returns for Custom Products. Due to the custom nature of our products, all sales are final. Returns, refunds, or exchanges are not accepted unless the product is defective due to an error in our fabrication process.
5.2. Defective Products. If you believe a product is defective due to our error, you must notify us in writing within seven (7) days of receipt. We will review the claim and, at our sole discretion, may offer a replacement or repair. Shipping costs for returning defective products are your responsibility unless otherwise agreed.
5.3. No Warranty. Fab Everything provides no warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, except as required by applicable law.6. Intellectual Property
6.1. Ownership. All designs, drawings, specifications, and intellectual property created by Fab Everything remain our exclusive property unless otherwise agreed in writing.
6.2. Customer-Provided Designs. If you provide designs or specifications, you represent and warrant that you have the legal right to use them and that they do not infringe on any third-party intellectual property rights. You agree to indemnify Fab Everything against any claims arising from the use of your designs.7. Indemnification
You agree to indemnify, defend, and hold harmless Fab Everything, its owners, employees, agents, and affiliates from any claims, damages, or liabilities arising from your use of our products or services, including but not limited to claims related to personal injury, property damage, or non-compliance with applicable laws.8. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Portland, Oregon. You consent to the jurisdiction of such courts.9. Force Majeure
Fab Everything is not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, labor disputes, supply chain disruptions, or government actions.10. Entire Agreement
